Possession of residential house and land

Querist : Anonymous (Querist) 30 December 2010 This query is : Resolved 
I have been in actual possession of a residential house and land since 1965. I have come to know that my cousin has purchased the residential house and land, where I am presently living, from some one (who might not or might be the real owner) in the year 1995.

Can my cousin get possession of my house and land now and dispossess me of my house and land?

Please help.

If the sale transaction made by your cousin is legally valid, your cousin may dispossess you and get possession of the house and the land. It is presumed that you are not the owner of the property by adverse possession and the seller is the real owner of the property.

It seems you bear a doubt as to the actual owner of the house which you are occupying since such a long period. I think you donot want to disclose material facts about this query.How can you expect to get a proper advice by withholding vital info. from your expert.
Why dont you obtain certified copy of the title deed from the local tehsil office or applying for E.C. of the plot.

He can take possession only by due process of law.

You can approach the court if he tries to dispossess you forcibly. If he goes to court,you can claim adverse possesion and contest the same.

In what capacity you r residing in house as a tenant, trespasser,or as a family member? you can go for factum of possession also.

I agree with expert Mr.Patnaik. The person asking the advice says after living in the house for such a long time, does not know whether the owner has sold out the property to his cousin or not. This is unbelievable and full facts should be disclosed before the forum if anybody really wish to use this forum for proper guidance and advice.

Is it believable that you are living in a house and do not know the owner ? Come with clean hand before raising query before experts.
