Can a respondent appear in person and without advocate

Can a respondent appear in person in a property suit in India. What are the provisions in this regard.

Anybody who has a case in the court (whatever may be the type of case whether matrimonial, property related etc.) can appear in person. If any one has already engaged a lawyer and if the lawyer is present in the court at that time the individual concerned cannot plead. In case the advocate is not present on any particular occasion then he can definitely appear for his own case.

yes.. anybody can appear for thier case as in person..

Order 3, Rule 1 of the Code of Civil Procedure, 1908:

"1. Appearances, etc., may be in person, by recognized agent or by pleader- Any appearance, application or act in or to any Court, required or authorized by law to be made or done by a party in such Court, may, except where otherwise expressly provided by any law for the time being in force, be made or done by the party in person, or by his recognized agent, or by a pleader appearing, applying or acting, as the case may be, on his behalf:

Provided that any such appearance shall, if the Court so directs, be made by the party in person."

If the Respondent can followup the proceeeings and effectively defend his case and he is acquainted with the procedure and and subject law , he can appear , but always it is required to take services of local Advocate in the said Court
