Procedure for succession certificate

hi, what is the procedure and documents required to apply for succession certificate as legal heirs in the absence of a will?

you have to file the deatils of legal heirs which may be by way of birth certifiactes or ration card or service record in case of govt employee or other documents wherein the relation of the parties have been mentioned such as wife, son and daughter.. election card,etc..

if all the successors of the dead person are in good terms, you can file an O.P(succ)in the Munsiff's court or Sub court according to pecuniary limit. There need not be any respondents in the party array, in such situation. If the successors are in hostile terms, array them as petitioners and respondents. A gazette publication or publication in a vernacular daily will be necessary. You have to adduce evidence to prove that your parties are the L.R's of the deceased. Above all there should be certain amount due to the deceased from some where. In its absence you will not be able move for a Succession Certificate.
