(Querist) 25 September 2010 This query is : Resolved 
sir, person has deposited some amountin pharmaceutical company which is running medical business,receipt has been issued without menturity date,till last year they have given yearly intrest, now they are not returnig money can i go to consumer court?as a deficiancy in paying back deposit and one year intrest?PLS ANS WER with case law.

you have to file a civil suit for recovery of your deposit amount. It is not a question of deficiency of service.

But I think case under Consumer Protection Act could be filed. In Kolkata, I myself filed several cases against a well known Non Banking Financial Corporation which also defaulted in paying the Principal amount with interest after maturity.

I agree with Mr. Barman. Consumer case can be filed. Non mentioning of maturity date in certificate is also a deficiency in service.

I think a case can be filed under CPA.
As for case laws, 1st. prove your case on facts. The rest will take care of itself.
