RISING OF SALARY BY M.PS

SIR I WANT TO KNOW THAT IS THERE ANY LAW WHICH CAN BE USED AGAINST MEMBER OF PARLIAMENT. THE LAW IS PASSED IN LOK SABHA AND RAJYA SABHA BY M.PS WHICH ARE ELECTED BY CITIZENS OF INDIA.AND AFTER THAT IT IS SIGNED BY PRESIDENT. IF PRESIDENT DOES NOT SIGNED IT IS AGAIN SENT IN PARLIAMENT FOR DISCUSSION. NOW, PRESIDENT IS BOUND TO SIGNED IT.
NOW REVISING THE SALARY OF M.PS 3 TIMES BUT THEY WANT IT FIVE TIMES THIS CAN BE EASILY BE PASSED IN PARLIAMENT BECAUSE THIS IS IN FAVOUR OF M.PS. IF IT IS NOT SIGNED BY PRESIDENT THIS WILL AGAIN SENT IN PARLIAMENT ,NOW AFTER THIS PRESIDENT HAVE TO SIGNED IT.

You have to challenge the hike either in the high courts or in the supreme court directly.

Though we are in the Democracy such aspects can never be challenged in any courts. Even if CAG indicts a sitting union minister who is responsible for loss to the exchequer running to several thousand crores and public money embezzled in excess of 70K crores in the name of conducting games, poor common man needs to shell out to pay the visit of US President, nothing would come out fruitful in this country. Whereas, after several years of struggle we got our salary hiked to the extent of just 17.50% and that too personally bearing the cost of pension to meet its corpus which was falling short to the extent of just Rs.1800 crores.

As a citizen we need to be only silent spectators unless or otherwise a mass Public Awareness Campaign works out.

Poor MPs, only this hike is going to help their daily livelihood. Let us pity them, as after all, they are for the people, by the people and of the people. Indian Judiciary has a bigger role to play.

Any Act passed by a competent legislature cannot be challenged in any High Court of SC unless it is ultra vires the Constitution. The Acts raising the salary of the MPs / MLAs cannot be said to be ultra vires the Constitution.
BUT BE SURE, THE DEMOCRACY IS WORKING IN INDIA AND THAT IS HOW AND WHY EVEN THE PRESIDING OFFICERS AND SOME OF THE POLITICAL PARTIES ARE TAKING A VARIANT POSITION AS FAR AS MPs themselves RAISING OF THE SALARY. THE DEBATE HAS STARTED.
We are a young nation. It is just 63-64 years after independence. Such period is nothing as far as the Nation's history is concerned. Just think, it appears as though only the other day each one of us were greeting for New Year 2010, not within another month we will be wishing new year greetings for 2011. Time flies. To effect changes it definitely takes time. As people of this great country, we should have faith, perseverance. Things will definitely change for better. The very fact that each one of us are agitating on one point or the other, and are able to voice it openly in public itself is a great sign that India has a vibrant democracy. The legendry Mr. Palkhiwala used to say in a democracy one need not lament, in fact the people have to demand and once they demand they will get it. All the changes small and big that they are taking place in the country are due to such demands by the people. Please do not think that all the demands will be met simultaneously and instantaneously.
I take it that others may differ from my view.

Yes, Constitutional protection is ensured to shield any of THEIR deeds or misdeeds in the name of democracy. If the so called Demands of our Honorable MPs will be met and decided instantaneously or simultaneously by THEMSELVES how can the same argument is not applicable to the people who elected them?

This debate can invite lot of sponsorship in TV channels to draw attraction but the real issues always get under the carpet. That is also the hallmark of our Democracy which would only help you to fetch good marks in your Constitutional Law paper in BL Degree course but would hardly speak the ground realities affecting the common citizens of this country.
