Limitation for filing FDP

Please let me know whether there is limitation period for filing Final Decree Petition and what is the period. Is there any provision for condonation of delay.

Section 5 of limitation act is the provision for condone the delay in filing any petition.

Can you please define Final Decree Petition as I have never heard such petition and its purpose and court wherein it is filed?

I think he is talking about final decree which will be the next step of, after passed the preliminary decree like partition suit.. Am also little confused so in my earlier answer i didn't answer about it sir.. Please now clear him.

In mortgage suit and all , first preliminary decree is passed . then, we have to apply for final decree which is called final decree petition. then only , the property is to be brought for sale.

Still you are not coming out with the facts as to in which situation you are required to file the Final Decree petition, when was the preliminary decree passed etc. etc. If you want an appropriate answer then you have to come out with more facts. We are not interrogators here to dig out facts from you in bits and pieces, then collate, understand the things and then to give you an answer.
