Dear Experts, Please clarify if serving of notice to respondent party is mandatory while filing an application u/s CrPC r/w 195. If it is mandatory kindly quote the relevant section of CPC. If not mandatory, please refer me the case law. THANKS.

Whether the case has already been taken cognizance? If so, it is the Court to summon the accused, otherwise, get an order of the Court. However, no need to supply advance copy as you are unaware about the outcome at the admission stage.
