vijay raj mahajan (expert) my next query is i have inherited property, ,but i want to Gift it or give it in charity, what is the best hassle free legal procedure to follow in either of the two ,& which better way than the other.
Guest (Expert) 04 August 2018
There is a difference between the terms of "dispute in property" and "inherited property." So, better explain, what exactly is your real problem, if it is not your academic query.
bose (Querist) 04 August 2018
i have no problem ,as per my fathers WILL i am the sole owner, but my desire is to gift or give it in charity , kindly advise which is better option ,considering Legal hassle free. procedure
bose (Querist) 04 August 2018
Hello where is that expect gone-
,who questioned if my query is academic- I say no,
now answer my query-
Guest (Expert) 04 August 2018
Your way of questioning the experts, i.e., "who questioned if my query is academic" is quite arrogant and still you expect help from them. Just interpret properly, what is the meaning of "what exactly is your real problem, if it is NOT your academic query.

In fact your own description is questionable. At first you stated that you have a dispute regarding a property. Thereafter you stated that you don't have any problem. At first make sure whether you have a dispute or not?

After you are fully satisfied whether you have any dispute or problem, you may go to some local copywriter or advocate in Tehsil office to get appropriate help.
Kishor Mehta (Expert) 05 August 2018
Make sure whether there is a dispute or you are the absolute legal owner. The advisable option would be to WILL the property to the charitable organisation of your choice. Alternatively you may give it as a gift but then you would incur the expenses of stamp duty and registration charges. The choice is yours.

Lawyer is a basic or generic term for all who study or completed Law Degree.
Guest (Expert) 05 August 2018
There is a thin line difference between Lawyer and Advocate.
Guest (Expert) 05 August 2018
All Advocates are Lawyers But not all Lawyers are Advocates.
Guest (Expert) 05 August 2018
The term Lawyer is applicable and simply meant that a Lawyer is a Person who had completed his Bachelor's Degree in Law.
Guest (Expert) 05 August 2018
But the term "Advocate " would be applicable Only To the persons who had completed his Law Degree but also had Registered with Bar Council (Presently there is an Entrance Exam conducted by BCI for Enrollment )and are governed by Advocates Act 1961 and Section 2 (a) of Advocates Act authorizing them to appear in Courts.
Guest (Expert) 05 August 2018
Hope this would Clarify.
Vijay Raj Mahajan (Expert) 05 August 2018
As the sole owner of the property you can gift the property to anyone by way of registered Gift Deed as charity, The applicable Stamp Duty will have to be paid along with the Registration amount for the process of Registration of the Gift Deed with the sub-registrar of the district where the property is situated.

replies given by experts namely Kishor Mehta, Narasimha, Vijay raj mahajan, are appreciated, but reply of expert dhingra is funny in nature. reason if i have to go to copy writer/advocate ,as suggested by him--- he should have told it the first place , this clearly shows he has no idea of dealing with situation when it comes to Gifts/charity law- any way thanks to experts who are brief & simple in answering .--thanks once again
K Rajasekharan (Expert) 05 August 2018
The so called experts, who ask unnecessarily insulting questions to querists, draws unwanted responses from them for further complaining, and give funny answers that have nothing to do with the question, really entertain us a great extent though they serve no useful purpose in sharing any trace of knowledge, definitely because of their ignorance of law.

Such experts must understand that a question in retort is not the answer to a question asked by a distressed person who seeks some sort of answer from a legal forum with great hope. The answer they eagerly await from this forum might be a beacon light in the darkness in which they are in.

Ask decent questions if you want decent responses. Above all the expert must give them some satisfying answer after such laborious questioning.

Give respect is the best way to get respect.

bose (Querist) 05 August 2018
K.Rajsekharan (expect) hope your post would would act as a beacon of light for the so called God almighty dhingra(expert)-give respect to gain respect, treat querists as patients and not Ginny pigs
Guest (Expert) 05 August 2018
Welcome and Thanks Author Mr.Bose for your Kind appreciation.
Guest (Expert) 05 August 2018
Mr. K. Rajasekharan,

Instead of delivering sermons, better you would have given him some advice, if you had some novel advice to be given to the so called distressed person with your much hyped legal knowledge..

Now I ask you a question You may treat that also as a funny question. The so called distressed person at first stated, he has a dispute in property and thereafter stated that he did not have any problem, in your views, in what way he is distressed, dispute in property or the process of gifting?

In fact, the so called distressed person tried to make fun of the experts, that includes you also, if you are really knowledgeable in law?

So, why not demonstrated your knowledge of law in such a contradictory distressed situation of the querist? Absence of any legal opinion on the problem of the so called distressed person, in itself, reveals lack of legal knowledge on your own part making your own position funny.

NOW, in your own words that you used in some other query, IT IS YOUR "ONLY DUTY", YOU MUST REPLY IN A SINGLE SENTENCE COVERING BOTH THE CONTRADICTORY ASPECTS OF HIS DISTRESS BY DINT OF YOUR LEGAL KNOWLEDGE.

Your posts, hither to fore also revealed as if you are against asking questions to the querists to seek background of his so called distress and also feel pleasure in delivering ethical sermons. It seems you consider yourself as an astrologer as well as a religious and ethical guru. So, that way, your appropriate place is in some temple, mosque or church, not in a law court or even at the LCI Forum. So, my sincere advice to you is to start preaching in some temple, mosque or church and also start predicting the real problems of the distressed persons, rather than at the LCI Forum.

Also, thanks for your advice, i.e., "Ask decent questions if you want decent responses. Above all the expert must give them some satisfying answer after such laborious questioning."

But can you point out, what was insulting and indecent in my post with question. Please read that carefully. I repeat the same below for you for pointing out indecency and insult that you would have noticed:
"There is a difference between the terms of "dispute in property" and "inherited property." So, better explain, what exactly is your real problem, if it is not your academic query."

You may also give your own version of the question that you would have asked in a decent manner.

IN FACT, MY QUESTION WAS NOT FUNNY, BUT YOU HAVE MADE YOUR OWN POSITION AS FUNNY, WHO HAS TRIED TO DELIVER UNWARRANTED SERMONS THAT TOO WITHOUT READING MY POST.

I endorse and appreciate the opinion and advise of expert Mr. PS Dhingra.
The experts are providing FREE social service at the cost of their time, efforts and intelligence to help out needy person(s), therefore, respectfully disagree with expert Mr. K Rajashekaran.

It is queriest who has to provide necessary and relevant facts of the dispute for analyses, form an opinion and advise him/her to the best of legal knowledge of the respondent/expert.

My request to all the experts/respondents to kindly avoid posting any remarks against our own colleagues who have contributed certain advise on the subject (query) in terms of input/facts provided by the author. However, whenever we are not in agreement with the opinion of an expert/respondent, please give your view, which shall be appreciated, if found to be legally correct.
bose (Querist) 06 August 2018
attention dhingra (expert) your advice to experts is---
if one is not thorough with the subject he should start preaching as per his choice of worship,
fine, point taken, one simple question to you is which --
shamshan ghat /raj ghat you represent.?
