Gpa cancellation

Querist : Anonymous (Querist) 09 June 2018 This query is : Resolved
I gave power of attorney to my dad for my apartment back in India. I did not maintain any copies nor did I take note of the GPA number. Is there any way I can get the numbers or copy if I need to cancel them or is there any other way out to cancel them by news paper notification without the details and then registered notification to the attorney and the registrar office? I remember I signed the GPA in notary office and not sure if it was registered or not. So in simple can I cancel the GPA without having details/copy of the GPA I gave some years back?

Thanks

Yes you can cancel the GPA that was signed by you and was notarised. You can inform the Sub-registrar Tehsil office or the Housing Board which has control/record of the property in question, about the cancellation of GPA given by you and tell them not to carry forward any transfer of the property by registration of any sale or gift deed with regard to the property for which GPA was given by you. Newspaper of cancellation of GPA should also be done and copy of Newspaper publication attached with the Affidavit cancelling the GPA must be sent to the authorities mentioned above as the case may be.

The definite way to revoke the Power of Attorney (POA) is by executing a revocation of POA deed.

Prepare a deed for revocation of POA. If the POA you want to revoke is a notarized or registered one, you will have to follow the same process for the revocation document.

Then send a copy by registered post to the person holding the POA. The revocation will come into force as soon as it reaches him.

Similarly send a copy of the revocation deed to the bank or institution where the POA will be acted upon and another copy for your official purposes.

May the process be different, but both the experts have advised rightly for the purpose. You need not get confused. However, the choice is yours.

Let me point out here that POA or GPA that is given for transfer of immovable property, namely for sale or gift to another person, the POA or GPA has to be registered with the Sub-registrar/Tehsildhar. The notarized GPA cannot be used for the transfer of immovable property. The cancellation of notarized GPA is good enough as it was never registered for transfer of immovable property. The Deed of revocation of GPA would have been required if the GPA was registered with Sub-registrar and that too had to be got registered with Sub-registrar.
