Deduction of salary for late coming/learlyleaving

(Querist) 02 February 2018 This query is : Resolved
Sir,
Our organisation recently starts to deduct the salary for late coming or early leaving for more than one hour. As per organisation approved standing order it is applicable to workmen category grade pay Rs. 4800. But HR section starts to deduct the salary for Supervisory and supervisor officer categories (other than workmen as per standing order and FR22)also. . This can be accepted or legally file or any other method since HR is not deducting for officers.

Do you feel that any court would support the event of late coming and early going, when full salary is received for the fixed hours of duty?
Why not be punctual to attend your duty?
Vijay Raj Mahajan (Expert) 03 February 2018
Certain rule not written but the usual practise on any organization that if subordinate staff has to follow certain rules, the superior are understood too follow those rules too. You make mistake and are not punctual for the work, even leave the office early and expect the complete salary for the job. The practise of attendance at the time of coming and leaving the office by the employees is by itself a rule to be followed and if there exists any diversification by the employee the disciplinary action can be taken, reduction of salary is one such disciplinary action taken by the employer.

What is your dispute for consideration, analyses, forming an opinion and advise you wherein your sole aim is (prima facie) to protect "late comers" salary/wages?

Thanks. Salary deduction is right thing. But Officers are staying at home and receiving full salary is it correct? That means workers are slave . No work no pay is for only non officers? Its not question of punctuality. What for rules made. and discrimination ? I am raised this event for innocent workers not for me. If everything is correct then why need of Labour commissioner and act. if all rules are made and followed punctual then any kind courts is not necessary. Whether we accept the British policy.

This is not the right place to register your complaint against your officers. Take up appropriately with the top bosses.

IT is not correct if officers stay at home and get paid with Salary and allowances and perks.
One need to have irrefutable evidence to establish IT.
Such matters are better taken up thru employees unions...

Kumar Doab (Expert) 05 February 2018
If you wish you may cite specific portion from FR22....

Standing orders may have narration on IT. You can check and relate.
Usually grace of 30 minutes might be kept and establishment may ask to work say;30 minutes extra also to clock full work hours.

Allowing 1 Hr is proper for reporting in ....

Allowing 1Hr before close of work hours is certainly irrational....
Allowing 1Hr to report in late then 1Hr early is certainly irrational...
