(Querist) 05 January 2018 This query is : Resolved
Dear Sirs
I am Viren Vora from Mumbai had applied online for Renewal of my passport & not mention current present address in application Due to ignorance of Rule & Hefty penalty of Rs 5000/ has been charged for small mistake I had requested to grievance & External ministry affair for consideration to minimum penalty Amt As its not any offence or Crime but ignorance of Rules mistake & Kind of Forceful Burden on common Citizen in Democratic Country. Passport office as no provision for Waive of Penalty & Ministry affair did not revert or Reply to mu request mails. I like to know whether i can file petition or Appeal direct in Supreme Court without lawyer against Law not seems right in public interest of Country citizens..As its wise decision pay penalty rather then Hire Lawyer to file appeal in Court

i request Lawyer panels to Properly Guide me to How to file appeal in Supreme Court against Law which is not in public interest of Country. Hope to get some Guidelines for same

Ignorance of law is no excuse to avoid penalty. However if you feel the penalty imposed is higher than it should be and there is no provision of condoning the mistake of the type you committed than you may send a direct communication to Minister of External Affairs and PMO for amendment of rules rather approaching the Apex Court directly. Yes you can send direct complaint to the Supreme Court and if found that such complaint is in public interest it may take your Complaint as Public Interest Petition and proceed accordingly.

Better to write a letter to concerned higher authority first, If you really interested in public affairs then consult with a lawyer and proceed further.

Why not, who forbids you from filing a petition? You can very well file a petition provided you are ready to waste more than Rs.50,000/- besides your precious time to and from the courts of law, just in a vain bid to save Rs.5,000/- Extraordinarily great thought on your part !

Best of luck.
