Selling handmade soaps without holding licence

hi all,
I am a homemaker and now am doing homemade cum handmade soaps in COLD PROCESS METHOD. Gave few samples to my friends and relatives, the feedback was very good. And further i tested my soaps for TFM which was 86 %. Though am making soaps with house hold materials like stainless steel vessels and hand blender ( earlier used for cake baking) . Approached the health department in the city and i was directed to read the amendments for cosmetic acts. As said its COLD PROCESS there is no cause for environment since its zero waste product do i need any certificate from pollution control?
My question is:
1) i make only 50-60 soaps in a week with COLD PROCESS where the oils & lye are blended and left for saponification and left for curing for 45-60 days then made into pieces with the help of cutter a lengthy knife.
2) it hardly doesn't need any equipment or space as mentioned in the cosmetic act ( just for around 60 soaps).
3) as said it should need non-residential area, i can't afford a place in industrial estate.
4) what will happen if i sell my soaps through online without any such licence and pollution certificate.
5) shall i sell my soaps keeping it in front of my house does it require any trade licence ( i don't have such).
6) no smoke or waste water is released in this COLD PROCESS, so does it require pollution control certificate.
I also approached SSI but i did not get any clear idea and help. And now i have found many doing handmade soaps at home and selling it through online and in their own shops without licence. Till now no inspection has been gone to those shops. So, does the manufacturing licence is a must for making handmade soaps. Please need a clear idea and help. Is there any way to continue my soap making at home itself.

Interesting, I will read cosmetic Act and then let you know. Additionally, on my facebook friends list, there is one owner of leading tooth paste company of our country will try to ask his opinion too because he may give instant ans. But just for your knowledge their family started tooth paste business when they were staying in 2 room chawl and today their brand is very big brand in that segment , So always think positively .

And I remember his father (or uncle ) not sure biography where he stated, Half life he spend in Court strugling with this burecracy and stupid laws which were big hurdle . So even if you do best thing to do legally still you will find your self violating some law and end don't be afraid of court /penalty etc.

Now I will tell you in Maharashtra they have multiple law and multiple registration 1) Labour Law 2) Municipal Law 3) Now you say cosmetic law 4) If pollution is created then that segment

Now when you do business or domestic home then you need not be afraid see tomorrow even society may take objection , so how many people are you going to satisfy .

So you need to be prepared additionally how many people are working with you , how much turn over you have financially , whether there is any risk while manufacturing (like explossion etc ) that you need to think and decide

They have made so many law that if you want to compile all law then you need to keep one man to do only compliance only then also there can be some defects

Making of soap is a benign business activity. You need not take out any permission so long as the said activity is not restrained or restricted by Law. Perhaps, the District Industries Centre would be in a position to assist you.

Generally no registration is necessary for tiny business entity like the one you have been doing from your home.
At the most you may get it registered under the provisions of Shops & Establishment Act.
Consult a local lawyer for proper guidance and proceeding.

May or may not be used cold process for manufacturing the soap, but since the soap is being manufactured for sale (may be in small quantity), but the dangerous chemicals like caustic soda is being used, that may require license from the concerned authorities under the Drugs & Cosmetics Act and Rules, 1945 by fulfilling the prescribed condition, e.g.:
1) Location and surroundings
2) Buildings (minimum 100 Sq. Mtrs. for small scale manufacturing)
3) Water supply
4) Disposal of water
5) Health, clothing and sanitary requirements of the staff
6) Medical facilities
7) Working benches
8) Provision of adequate facilities for washing and drying

Get the guidance from District industries center, get activity registered with them. They would guide what procedure to be adopted and requirement for registration in your state with various agencies.

Can use Khadi and Gramodhyog platform for promotion of your activity.

One practical reply. Donot ask any of these question to any lawyer or any government authority. I have been in an institution related with industrial finance and know how these pollution and DIC works. If you really want to start business just consult any businessman and he will advise you that if you get involved in formalities you will never be able to start any business.to learn swimming you to take a plunge in water. So start the business you want to start and when any difficulty comes you will yourself learn to resolve that.On thaat day your local lawyer may be of help to you
