Goa property

(Querist) 07 August 2017 This query is : Resolved
There are 6 brothers who own a property that has been handed to them by their mother (now passed).
One brother is refusing to sign papers to sell the property to a developer (already interested and wants to pay now).
Can the majority rule if only 1 of the 6 shares refuses. How can we get him to sign the papers for sale?
P. Venu (Expert) 08 August 2017
There is no rule of majority in such cases. The five persons can sell their share.

The developer want to deal with one sale and not buy 5 and have a battle with the reluctant party. How can we force the reluctant party to be part of the sale?
Rajendra K Goyal (Expert) 08 August 2017
In such case deal can not be completed. Majority can not force any one to sell his share.
