Information provided by you is still incomplete.

Please clarify:

1) Whether the cheques bear dates of issue?

2) Whether cheques were crossed or bearer?

3) Whether any written agreement is there for out of court settlement?
Rajesh S (Querist) 02 January 2017

Dear Rajesh,

Non-CTS cheques are invalid, but are accepted only by the concerned bank as their own cheques, not by other banks.

So, if Non-CTS cheques, if presented as self/bearer cheques in your own bank, even if dishonored, may not have any effect on you.

Even if crossed by opposite party and presented in some other bank to be credited in to their account, the cheques will be dishonoured as invalid cheques, but not for shortage of funds. Even in that dishonor case, the party will have great difficulty in proving that the cheques were issued only recently within the validity period and also that you owe some amount to that party. However, copy of written settlement agreement may help you to a great extent.

So, you are not required to be worried so much for the blackmailing tactics of the opposite party.

Lodge police information regarding loss of signed blank cheque. Also mention that the person may be having the cheques and about his blackmailing.

Inform Bank regarding stop of payment of the cheques.
