Respected Sir, I m an advocate i want to know that on demise of a labour in accident, how much the court will asses monthly income of the decesed person whareas his monthly income is not certain. Kindly slove my query.

In case of uncertaintay, you may prefer your claim based on minimum wages of your state, as per the category of skilled or unskilled labour, and the increasing trend of of wagges from time to time based on the cost prise index due to inflationary effects.

Is yours a real problem or an academic query?

Earlier you asked, "how much the court will asses monthly income of the decesed person," now in contradiction to above, you have stated, "tribunal has observed 3500 monthly income." Is not a contradiction in your statements. Did you try to test the knowledge of experts?
