builder do not registered the flat after taking full payment

sir please advice and answer my queary. builder do not do registration after taking full payment before 2 years. he could not responded to phone calls and emails. Even IDBI bank from where I have take home loan before 5years have not take any step against builder after repeat complaining. would u please tell me how long the builder can take to give possetion of flat after completing the project when there is a homeloan going on. Can bank take any legal step in this scenario.

You have wasted enough time.

Bank has disbursed loan and you are liable to pay.


Now approach an able lawyer specializing in consumer/property/civil matters and show all docs on record.....................and proceed under expert advise of your lawyer.

It is surprising to note as to how bank u given loan without creating mortgage of flat. Any way see the clauses of agreement and serve legal notice that when 20% amount of the flat is made builder has to register the agreement.

Bank deals in money and not in flats. You have taken loan by selecting flat / builder and you are liable to pay back to Bank.

Consult / discuss with local lawyer and file consumer complaint.

Friends thanks a lot for the suggestions and guidance so far. Need some more advice on below concerns
1. Presently I work in Patna and builder/property is in Bhubaneswar. In case I file a case in consumer court, do I need to frequently travel to BBSR which would be impractical in the kind of job I am
2. Builder had sent me possession letter 6 months back by post which I did not sign and replied. I communicated to him by call and mail that I would not sign any possession letter until registration formalities are complete and he deposits the sale deed with bank as it is nearly 1 yr since I have paid him full amount for registration. Can the builder paint this in a different manner that the customer is not ready to take possession due to which there is a delay
