blank cheque

sir first of all this is a great system which you provide to us solve our problem. my problem is that i have taken 3 lacs rupees from someone in 2013.and gave him a blank cheque without amout däte nd name and i write 2℅ interest give every month of total amout on simple page for two year and i didnot gave him total rupees but gave him some rupees lumsum 2 lacs and now in 2016 he deposited blank cheque in bank and found not amount and he wrote amount 12 lacs in cheque while i have not taken and i have not any proof and sep 16 send a notice by reg. post to deposit money within 15 days .so how i handle this problem please give me a suitable reply so how i can defend myself.

Reply the notice through your lawyer. If you rebut having any liability then the complainant has to prove by leading convincing evidence.

You need not to worry. Do as per advice of your lawyer but reply the notice at the earliest.

Definitely this is change in the version but the author is free to add new facts when he is identifying himself.

He has two IDs one with the name ANONYMOUS and another with the name PAWAN. It means, when he raises a query under ID with the name ANONYMOUS , experts should remain away but when he raises query under the ID with the name PAWAN, he is welcome.

sir it is my id pawan but i m using it first time and i dont know how to use it anonymous or name so i send it both with different meaning and in future i will send by name and first time i send it knowing solution so i send it different subject and sorry for that i remember next time

Of course, this is a great system to solve your real time problems, but not for misuse to solve the academic queries of students. Your query seems to be a hypothetical academic query, not a real problem.

If there is any truth in your story, better hire services of some good lawyer locally, as replies to your casual query may not help you solve your problem.

By giving blank signed cheque, you give the holder authority to complete the cheque and deposit in his account / present for payment.

You should have given registered notice to holder for not presenting the cheque.

Now defend the case against you and prove your innocence.

Engage some senior / experienced lawyer in the field and reply the notice received by you.

You have still not disclosed whether you had given the reply to the notice received to yo u prior of filing of the complaint as this is the mandatory requirement on the part of the complainant to serve the notice to the accused and demand the amount of cheque within 15 days of its receipt.

Non-reply of notice gives dual side benefit. In such situation even the accused is not bound by his earlier stand.
