Written argument

(Querist) 20 November 2014 This query is : Resolved
Dear Experts,

Judge ordered both the parties should submit the written argument on the same day.We submitted written argument on the right time but the opponent lawyer was not ready. After accepting a copy of our written argument Opponent lawyer said she is interested in oral argument and next date she finished her one sided oral argument in 5 minutes.I don't understand why she was interested in her one sided oral argument and why opponent lawyer waited for our written argument copy and later in next date she completed her oral argument. What does it mean? Please help.Thank you in advance

in order to save court time some judges insist that written arguments be provided . it is good that you filed written arguments as it is matter of record . the OP lawyer wanted to see your written arguments so that she could rebut them during oral arguments . it would have been in OP interest to file written arguments

It is a good practice to start with Oral Argument. , and once you are sure, judge noted your vital winning Law Points, and noted it in writing, at the end, submit your Written Argument.

Op lawyer try to note youe winning point, and try to do homework in opposing those points with citations, facts and authorities.
AFTER ALL, IT IS WAR.

The opponent lawyer got the opportunity to prepare arguments and rebut your written arguments.

Dear All,
Thanks for the information.Do you think it is fair?As per the direction of Judge both the parties should submit on the same day but the opponent lawyer changed the sequence and collected our copy of written argument.
Few questions,
1)Do you think that Judge must have noted this point in the court record or diary?
2)Someone told me that you should not worry about argument copy because before passing any order Judge will also consider the main petition and then pass necessary orders.Passing the order is not only considering argument but also scrutinizing main petition/written statement. Is it true?
Thank you.
