Asking all such questions here from experts and that too for free of cost rather engaging service of lawyer for legal case discussion and consultancy you are just wasting your time and energy here. Best suggestion for you is to engage service of experienced lawyer and discuss your problem with him.

Yes, the provisions of NI Act 138 has virtually created a Frankenstein; but it survives not because of lack of legal elements to counter, but due to disappearance of truth from our Courtrooms.
