In 1981 eye specialist doctor can give sign mental fit certificate on will deed.

Eye specialist is also a doctor having basic degree of MBBS.

He has a license to practice as a doctor.

My grand grandfather make will when they are 85 year old in 198. They give thumb impression on this will. Also eye specialist doctor certified on this will he is sound. So my question can this doctor have authority to certified this issue. And District session court dismissed our plaintiff order of my grandfather.

only general physician doctor who is at least MBBS can issue said certificate,.

But this will made in 1981 that time also this rule exist. Also our lawyer not admitting this above question as well as session court judge. So this happened against us which is right or wrong.

As stated above, eye specialist have also a degree of MBBS prior to going of specialty in eyes.Court and your lawyer is correct.

However, if not satisfied may move for appeal.

Yes, an eye specialist has the basic medical degree; his certificate is valid and authentic.

Mental fitness opinion by atleast an MBBS doctor as rightly advised by Senior Mr.R.K.Nanda is legally perfect.But here the Certificate should certify the Medical fitness also including fitness of the eyes for which the concerned doctor had specialized.

It is believed that this doctor whom you refer as Eye Specialist is MBBS, DOMS or MS........

Being MBBS and trained doctor he/she can assess ability to see what is written in WILL, property being disposed by WILL, understand the contents that he is to sign................or basic cognitive functions.....
