Dear sir,
My friend got married 4 years ago.now they have 3 years baby boy.recently my friend realised that his wife has illegal contact with her college boy friend and got some proofs also.now how is thinking about his baby boy(child).want to apply divorce .how to get child from mother to father.kindly help us.we are hindus.

Premature query!

The question of child custody cannot arise when there is no such event of divorce. Let your friend apply first for divorce then seek lawful help from the lawyer he engages for the divorce.

UR friend could have himself posted his problem,why do U want to represent him. The stage is still"WANT TO APPLY DIVORCE" long long way to go for child custody.

Generally custody of minor child is granted to mother, provided the court is convinced with the claim of the mother and benefit of the child.
