(Querist) 26 September 2016 This query is : Resolved
Dear sir, i know that validity of the cheque is count from the date mentioned in the cheque but in my question is if cheque is lost/missing and party inform the bank before the date mentioned in the cheque for Example: Mr. A inform the Bank 22.07.2015 for missing/lost the cheque but some body got the cheque and mentioned the date 19.11.2015 on the cheque. than who is the date count in this case as per previous supreme/high court judgement.

How you are concerned with the contents of the query?

Why A has not lodged DDR when the cheque was allegedly lost?

What reply has been given by A to holder of cheque?
rajeev sharma (Expert) 26 September 2016
who you are in this transaction drawer drawee or bank ? Inform your status so that penion may be given
Rajendra K Goyal (Expert) 26 September 2016
Whether any DDR lodged for lost cheque?

Whether cheque was signed in blank and was without date?

If so, the story of lost cheque is not convincing.

court may not agree on this till solid grounds provided.

Mr. ANURAG GARG,

For what specific purpose you want to know about "previous supreme/high court judgement," and how you propose to use that when your problem is neither clear, nor seems to be related to you?
ANURAG GARG (Querist) 26 September 2016
Sir
Mr. A not lodged DDR for lost cheque because he is not known about the future misshaping some body this cheque only report to the bank for this lost/missing cheque. Mr. A is drawer and only signed cheque was lost, no date or any information fill in this cheque.
Mr A Reply to the holder person it is the lost cheque in his notice.
My query is who is the date important in this situation.
Guest (Expert) 26 September 2016
Mr. Anurag Garg,

My question was not for clarification on ABCD, etc. of the drawer or drawee, rather your own concern with the problem and the purpose for which you asked for SC/HC judgments.

You have not replied on that issue.

So much of repetition?

It is misuse of resources.
Raj Kumar Makkad (Expert) 28 September 2016
Misuse of this noble site should not be permitted and author should also keep in mind that the experts provide them valuable time and energy without any reward so they themselves also try to search replies on similar subject given by experts previously.
Rajendra K Goyal (Expert) 29 September 2016
A real misuse of the facility.
