it would be criminal case as has been prevented from entering one own residence by force
Rajendra K Goyal (Expert) 18 September 2014
If it is his house ,it is criminal at and if police does not lodge FIR, complaint to the magistrate u/s 156(3) Cr.PC should be filed.
Advocate Bhartesh goyal (Expert) 18 September 2014
Yes,it would be a criminal case.File complaint before magistrte having jurisdiction.

not agreed or disagreed. The querist has just given no facts. If full facts are given the answers may be same or inverted.

I do agree with the in-depth study and wise reply of Sudhir. The author is required to put more facts.

actually I have been living there but

the place is rented one

but

1)I have electricity connection
and water connection on my name

2)I have original bills which i have
been paying and

3)New connection reciepts of both the
electricity and water connections

CAN I still register criminal case
for forcefully preventing me from entering
the place of residence.

as police is refusing to lodge a complaint

CAN complaint against police can be made for not registering the complaint.

Please suggest what legal procedure to follow in such case.

thanks.
