Urgent help needed

(Querist) 25 August 2016 This query is : Resolved
Hello Sir's
I am working as a HR in a organisation in NCR.
We have certain cases of absconding employees for which the management has decided to pursue legal options.

We need to first start with sending legal notices to such absconding employees.

Hence I am requesting your help as I need to give an estimate to the management as to what would be the cost of sending such legal notices to absconding employees.

I just need an approx figure if its not asking too much.

Would be very grateful for your help.

Regards

Shreya

Ms. Shreya,

At which post you are employed in the organisation?

What is the total No. of employees in the organisation and how many out of the total strength are absconding?

Kumar Doab (Expert) 25 August 2016
Why so many employees are absconding?
kavksatyanarayana (Expert) 25 August 2016
Refer the rules framed under your organization or reply to the questions asked by the above senior experts.
Sudhir Kumar, Advocate (Expert) 26 August 2016
please given necessary facts.
Shreya Singh (Querist) 26 August 2016
There are in total 15 employees absconding in the last 12 months.
I would only want to know what it would cost to send a legal notice and henceforth.
Shreya Singh (Querist) 26 August 2016
The employees absconding are at junior management level.

You have not replied my question in full. Is there any specific reason for not replying my question in full.

Please clarify the following points for the purpose of real analysis of your problem:

1) What is your position in the organisation?

2) What is the total strength executives of junior management level of your organisation?
Kumar Doab (Expert) 26 August 2016
I concur with Expert Mr. Dhingra.

Your section should draft notice, get it approved from management / legal cell and dispatch the same to absconding employees by registered AD post. Notice after minor modification can be sent to each absconding employee.

May search web for drafting such notice.

I think this is not the way to pose such commercial offer in this section of LCI and surprisingly keen interest shown by experts in the lollipop by author.

Mr. Author! You need to personally contact either of the experts or the person of your choice and please don't pollute this charity section.

Makkad ji,

The query of the author can not be assumed to constitute a real problem. It can also not be a lollypop by the author. It is surely a part of some academic query on getting some suitable reply for which, she can be expected to come forward with some supplement questions. Not being a realistic problem, she must not be finding suitable reply to reply my questions, being not able to get any realistic picture out of a hypthetical situation.

She does not seem to belong to any company that could be facing a mass scale desertion that too of the managerial staff. Had that been there, the author on behalf of the company would not have posed such a casual query that too without any statistical figure. They would have rushed to some service law expet for serious study of the problem and to make some tangible recommendations for future to avoid desertion of employees.

The figure of absentees given by her is quite unrealistic. It is a matter of commonsense, if a large scale of managerial staff leaves the company, the company is surely not an employee-friendly company. Had that been the situation, the company could have shut down, as if the management staff is absconding on large scale, there was no reason for the lower category staff to get stucked to the company due to ill treatment of employees by the company.

The proper answer lies with the legal counsel your company may engage.

The author did not reply to my question as well.

'Why so many employees are absconding?'

There are threads at LCI as well that show that employers arbitrarily declare employee(s) as absconding in its internal records.
Rajendra K Goyal (Expert) 03 September 2016
Agree with the assumption from expert Kumar Doab.
Kumar Doab (Expert) 03 September 2016
The author has probably understood and has wisely approached the counsel of establishment.
Sudhir Kumar, Advocate (Expert) 04 September 2016
15 employees absconding in one year.

what sort of company is this.

Are you an unfair employer and seeking free legal advise here.
Guest (Expert) 04 September 2016
The author needed URGENT HELP, but did not feel the need to supply the needed information for the last 9 days.

The author has not replied about her own position in the company and the total strength of employees even after elapse of 9 days, which in itself proves that her question was hypothetical.
