Urgent help

Please help
I am a civil engineer running my own business of houseconstruction .
I had given multiple cheques of Rs 25k total Rs 60k to some carpenters and fabricators way bay in Jan-17 due to demonetisation.
As a practice I had not put in the name of the beneficiary on the cheques nor dates.
As the cash availability improved I handed over cash to the people I had given cheques however it was in instalments.
These carpenters and fabricators who had cheques assured me that they will not encash the cheques but not return the cheques till full payment is received from me.
However a couple of cheques were encashed by one of the carpenters of the full amount eventhough they were well aware that such cheque if en cashed would bounce.
Now even after many requests they are threatening me that they will present all the cheques which they very well know will bounce. I also requested them to handover all those cheques for which they have received cash but they are not returning.
Another problem is that I am unable to find the details of the cheques I had given.
What should I do as I have no money to pay and the balance amount.
The cheques of are of ICICI Bank.

Your story smacks about some hypothetical academic query, as nobody can anticipate materialization of such type of threats by some illiterate and semi-literate persons, like carpenters and fabricators.

However, if there is even the slightest of truth in your story, mere threat has no meaning, unless there arises any practical problem that too from the side of some illiterate or semi-literate persons you talked about.

More so, if the threat is in reality and urgent help is desirable, you could better have contacted some local lawyer along with proof of payments, you have made to the said workers.

However, if you don't have any proof of cash payment, at legal parlance, no remedy can be possible a blunder mistake that too by a learned person, like a Civil Engineer cum a businessman.

BY THE WAY, how could you think that your own petty workers would sue you collectively by filing a criminal case on you, as you categorized your query under criminal law that too for different amounts of Rs. 25K+25K+10K working out to a total of Rs.60K, as you stated, "I had given multiple cheques of Rs 25k total Rs 60k to some carpenters and fabricators way bay in Jan-17 due to demonetisation"?

Get the details of all blank cheques issued to you by the Bank, balance blank cheques available with you and cheques already debited from your account should be sorted out and you would be able to find the cheques issued.

You have issued the cheques with out name of payee, if you are unable to get these back cheque bouncing case can be initiated against you.

Try to have amicable settlement. Avoid issuing any blank cheque.

If not possible, discuss in detail with your lawyer.

Record their calls/visits, threats and let them admit that they have already collected cash.


Try and build some evidence in your favor.
Builders at many locations have their own forums/unions.


Become a member and seek their help.


They may be able to resolve the matter.
In future don’t commit such blunders.

If you are unable to handle entrust to a very able senior counsel of unshakable repute and integrity at your location.


Or swallow the loss of Rs.60000/ obtain Full and Final Receipts along with their ID proofs, original cheques, and close the matter once for all.

Dear Shri NJS Rajkumar,

Your revelation, "He had posted several messages to the Experts which initiated the battle" not only confirms about his cowardly efforts to defame one another against each other, besides proving that he is also a back biter, if he posted messages to several experts. Earlier, he used to post messages to me also against many experts in his bid to use me as his tool against them by keeping himself behind the veil.
