Pls help to guide me the appeal procedure after sudden termination. Is there any chance to fight for to get revock by current emplyer. How could i get all the benefits after termination. Most importantly how could i get a Reliving letter on good note from current emplyer.

To. exp is 13 yrs. Working with Icici Bank as Manager loans since 3.5 yrs as confirmed employee. They terminated me just now in a last year case of loan where customer was fraud. But the case was not mine. After receiving termination letter in this month i have sent them appeal mail also but till time no reply came. What i do now. 17 days have passed by and i am not sure whether they will revoke me or able to give me reliving letter in good note or not. Should i wait more or should i send mail again to the MD or somebody else. They told me the tat of 30 days maximum. But how could i do without jobless that is a question after so many years and in liabilities.
please guide in humanity. i want the job back can i will get?

The question is does your termination letter mentions the reason to be the particular loan and if so, whether due procedure was followed.

It seems to be an academic query, as no background or case history of the case has been given by you, more specifically the process adopted by the bank to terminate you.

Discuss complete background of your case and whether the bank conducted any departmental or domestic inquiry against you bfore terminating you and what was the whole process adopted by the bank in departmental or domestic inquiry, if any.

The author has posted that he has filed appeal to management of M/s ICICI Bank and is expecting to get relief.


The author wants relieving letter with good note.


It shall be although strange if competent authority M/s ICICI Bank issues relieving letter with good note ,after effecting termination on suspected fraud.



If the internal option of appeal (?) is exhausted then the author needs to approach a very able counsel to defend his interest.




There is his own interest author should respond to the points raised by Expert Mr. Dhingra.

I really thanks for the guidance provided. its almost 25 days gone now and i am waiting for the so called decision after appeal in icici bank. The question is will i receive a relieving letter on good note or not? and in how many days? to wait somebody is not a right thing bcoz like me one can suffering from his liabilities. i defaulted on loans this month? how do i do now? i have not done any fraud. if you came across this kind of examples please guide me further urgently because without a Good reliving letter i can not able to get a job and i don't think icici is a more powerful than suprem court which has given decision of termination that too without any notice, reminder or not seen an performance and work experience. icici don't hve right to spoil anybody's career. Thus i have a trust that there is a scope of getting reliving letter from icici bank by challenging to them but how and when that i don't know? what is the law on these kind of unemployment that i don't know? need excellent advice and a way of direction to proceed further it 26 days past now.

Mr. Chetan,

I can understand, your problem can be serious. But you have to understand that your official position and personal problems are altogether different. You have to fight both adversities separately.

So far as your relieving letter is oncerned, you cannot expect a good receiving letter in termination case until your appeal with the competent appellate authority is decided in your favour.

Further, so far as your trust is concerned, as you stated, "i have a trust that there is a scope of getting reliving letter from icici bank by challenging to them," you seem to be mitaken. Once you challenge the authorities personally or even through court, you would get your case aggravated further, besides making huge expenditure and waste of time & energy on your part, which may further add fuel to the fire by aggravating even your personal problems, as you said you are sufferring financially and defaulted on loans also.

So, the only way is to remain submissive with the authorities for the present and get your appeal decided in your favour. Once you challenge them legally, they cannot be expected to yield easily, rather would try to show you responsible for several irregularities while on service.

So, keep patience till your appeal is decided. If appeal is not decided in your favour, you may get your service related documents examined in person by some capable service laws expert to guide you properly for the future course of action, if you are so particular about your present job only.

In the process of termination there might be many stakeholders.



Who has erred?

Who will accept the (his/her) error, if any?



How did you relate the matter with internal/private SOP, Conduct and Discipline Rules of M/s ICICI Bank and point out your innocence?



Do you have copy of SOP, Conduct and Discipline Rules and all papers pertaining to this case of fraud?



Have you shown all of these to your able counsel?



If yes what is the opinion of your own counsel?



If there has indeed been NO error at your part then M/s ICICI Bank may and should call back the termination order.



Have you related and pointed out, successfully?


Try upto the level of MD,Chairman and wriggle out of the situation.



If M/s ICICI Bank does not give you clean chit and if you are innocent, then the last resort is thru your own able counsel in court of law.



After all court is 'parens patriae'.
