Trespassing & pumping public drainage into private property

Local Municipal corporation is pumping public & street drainage into my private property inspite of my asking them not to do. The Municipal Commissioner comes into my property and directs his staff to place the drainage into my personal property. What criminal or civil action can I take against the Municipal commissioner. What evidence should I gather before I do anything.

immediately you file Writ Petition before the HC, they have not rights to ditch your place without permission

File a writ petition in high court. It would yield result. Civil and criminal case will take long time. if you are nevertheless interested then file criminal case of trespassing.

Get a FIR registered against the commissioner personally and file a writ against the municipal commissioner.

File a mandatory injunction suit in the civil court and also contemplate to file a writ before the high court to restrain the Municipal authorities from proceeding with the intended action and also get an order of interim stay till the proceedings are disposed.
