Transfer a padgi system room

We have a house in pagdi system in mumbai in the name of late grandfather. We wish to tranfer the same in the name of my father but landlord is asking for 10-15 lacs for transfering. we dont have capacity to pay such a huge amt. In case of redevelopment, can the ownership will transfered automatically in my fathers name?

I understand you want to transfer the receipt (because except receipt no document where created those days) from your grandfather to your father name.

Your relationship between land lord and tenant is governed under the provision of The Maharashtra Rent Control Act .

According to Maharashtra rent control act

Sec 31 (2) ---- Every landlord shall, without charging any consideration, issue the rent receipt in respect of the premises let out to the deceased tenant in the name of the family member referred to in sub-clause (d) of clause (15) of section 7.

In short if your father is residing in suit tenement then land lord is bound to transfer the tenancy in his name free.

If he does not transfer two option 1) Mutually settle 2) Go in small cause court with further relief of fixation of standard rent

IN redevelopment some towns in Maharashtra Development control rule have stated 750 sq. feet of flat free of cost to tenant

But many rules are getting changed frequently in this matter , Even amendment to act was proposed but due to politics of municipal election they where silent.

So changing rules / Act will affect ans. to your question
