To own my granfathers property

Querist : Anonymous (Querist) 30 November 2015 This query is : Resolved
My name is Amarnath.my grandfather died before some years.he has 4 sons and3 daughters.my father was 2nd one in that.my father left my mother and me when I was studying preschool.now I am studying in college.the question is my grandfather didn't give his property rights to any of his children's.now he was dead .now can I get a share in his properties?
Advocate M.Bhadra (Expert) 30 November 2015
If your grandfather died intestate(without making a will) then your father has 1/7 th right over the property. You can not claim the property during life time of your father who left your mother and you. Now your father has right to sell/gift to anybody which will be treated as self acquired property.

Moreover, if you do not have any information or trace of your father then you can file a case for Civil Death in Civil Court after lodging a diary to the Police.

Try to find out if any FIR was lodged/ process to locate your father was initiated and share everything with your lawyer and your able lawyer will initiate the process for declaration of civil death.
