If the Government had not taken vacant possession from the original holders, how fresh pattas were issued?
It appears that only a part of the problem has been stated.

the possession had taken by the government but the old pattatar was restrained the new pattatar by aggressive manner with the help of some political power.
Dr J C Vashista (Expert) 11 February 2016
Was the cancellation of old patta widely published by the government before/after taking possession of the government land and individual patta holder was informed qua cancellation of their patta?
Whether the new patta's were issued as per new policy of government? If so, the Court will have to pass a decree the possession in favour of "new" patta holder.
