Dear Sirs,
I am a member of a cooperative society in Mumbai. I have a question. The current committee got elected in January 2010 for the period of 3 years as per the bye-laws of the said society. (Annex ‘6’). Their term has been ended in January 2013 however there was not election program declared. Not only that, the entire committee is still functioning as the office bearers with being elected.
They have still not adopted the new bye laws. Now they have called for AGM on 28th September 2014.
My question is if they legal rights to call for AGM. If not what action can be taken?

complain to DY registrar that although term of AGM has expired fresh elections are not been called

But Sir can they call for AGM? Do they legal rights?

once term of MC has expired fresh election have to be called for .
