Termination from services in an engineering college

(Querist) 14 December 2017 This query is : Resolved
Dear sir/madam,
My friend who is working in a private engineering college since 4 years. Under the medical grounds, he has taken leave for 2 months with the approval of chairman and principal. After recovery, the college management is not allowing to rejoin in the college. Simply saying that they dont want. He is not having any bad remark in the college. Neither they have given a notice nor any payment during his sickness. They are holding the his certificates also. This is the crucial situation in the middle of the academic year. Kindly suggest to resolve the problem.

The leave as per your post is approved.
Hope you have the copies of approvals.
Submit a gentle communication under proper acknowledgment mentioning narration of visit to office to join after approved leave and that employee was not allowed to join, and the remarks made and request good offices to let him join.
Thu employee can build record, for future use, if required in appropriate forum.

Perspectives: The affected employee can firm up next venture and join there and past employer may issue said certificate.
The next employer may absorb on the strength of copy of appointment letter, salary slips, leave application and its approval etc
The employee can attempt to resolve the matter by his/her own skills of persuasion, persistence, reasoning, negotiations or by applying his/her resources that matter………………or with help of employees’ forums, officials in regulators………….

Or approach Educational Tribunal or jurisdictional Courts of Law..

Te title of your query is about Termination.
The query does not clarify if termination is effected and order is issued and supplied.
The declinature to allow joining may amount to ‘Deemed Termination’, per facts on record.

How you are bothered/concerned about termination of services of your "friend" who is stated to be working in an Engineering College, wherein your "friend" is supposedly a well educated person?

Let your "friend" may come out with factual facts of the case before a local prudent lawyer.
