Terminated during medical emergency

I was terminated while i was admited in hospital. They sent me two warning letters by post at my home they were also received by parents. Since papers was in english they couldn't understand. When i was discharged from hospital my parents told me about these letters till that i was terminated and sent my termination letter to my home. In termination letter they said me to pay amount for both not serving notice period and dues pending. I paid them money in stipulated time. Now, they are refusing me to give me reliving letter and experience certificate. It has been more than two years but i still have to get experience and reliving letter. I also contacted them through e-mail numberould times but they in a very arbitrary way.

In termination case, relieving letter is not necessary.

But right now i want to join a government service for that they are asking for satisfactory reliving letter from previous employer. Is termination letter is satisfactory in nature ?

Termination during sickness is usually a bad order.

Did you submit proper sick leave intimation and do you have proof of submission,delivery, copies?


Service Certificate has to be issue to all employees.


Relieving letter signifies that nothing is due towards employee.

Do you have proof of having paid the notice pay/penalties etc?


If yes nothing is due towards you.


Falling sick is not misconduct.
Hence no adverse comments should be inserted in service certificate/relieving letter etc.

Why did you not approach your able labor Law Consultant/service Matters lawyer for 2years or even your employee's/Trade Unions leaders?


Your case warrants detailed examination of all employment related papers and communication so far hence you should spend quality time with your counsel.
