Can a Govt. Servant may be suspended without serving any charge sheet. An electricity theft is detected on my feeder and all are suspended working on it. Is it legal.

The reason otherwise is known to you.

Download the Conduct and Discipline Rules of the establishment applicable to your designation and go thru these.

Check the currency period if specified to serve the memo of charges/charge sheet in it.

It shall be appropriate to initiate efforts to find a very able counsel specializing in service matters and prepare your defense and a 'Defense Assistant'.

Suspension is neither a stigma nor a punishment hence it can be ordered if the department prima-facie is satisfied about something wrong and intends to initiate departmental action.

Howevr, there is nothing wrong in suspension before charge sheet. It is as per the provisions of the Government rules.

By the way, you are employee of which Government department?

You may submit appeal to the appellate authority against suspension or wait for the issue of charge sheet to know what is the exact charge.

If considerable period has lapsed and no further proceeding has taken place only in that event, the appeal can be made to the disciplinary authority against such suspension otherwise even have no cause of action to do so.
