Stranger's claim on a high court partitioned property

Can a stranger move civil court for declaration and possession of a property which is already partitioned and passed on to next generation and further probated in somebody's name.

A property partitioned between two parties in HC and decree passed in 1968. The third generation of one part of the partition laying claim on the other party on the third generation of the other part of partition on some malicious grounds at lower court and this lower court entertained it mechanically and also passed ex parte order of Inj and Status qou. Hope this attracts S 9 of CPC, pls clarify. If further detail of case needed, I am ready to divulge.
