Stay on construction by disowned sons wife

(Querist) 10 October 2015 This query is : Resolved 
DDA Property was joint on the name of my mother and father. After fathers death share of property was equally divided in the name of mother andtwo sons. Elder married son
Relinquished his share in the name of brother. Two years after that mother disowned his elder son and was given posession of property by court. My question is whether elders sons wife can put a stay on any construction or renting or selling of this property claiming that i was fraudently evicted from home as i wz nt the party in the suit of posession.?

The share from deceased father devolved upon elder son. This should become his self acquired property. His wife has no forced share in elder brother's self acquired property.The elder brother by his sweet will relinquished his share by registered deed in favor of his brother.



Thereafter elder brother and his wife has no right and share.


The elder brother's wife can stay with his husband.


However you may show all documents on record to an able lawyer specializing in family/property/civil matters.
