Sold govt land

Dear Sir

I purchased one agriculture land from one MR.X, he said land title is clear and same is mention in registration papers and agreement papers. But when we applied for patta pass book, we received MEMO from area MRO saying that land is govt. land and it was lavani patta land. and registration is not considerable. when we ask the same with that person he said i will return back your amount and issued two cheques and those cheques were also return back 9 months before.

Kindly advise what action we can take against him

File a suit against the vendor after issuing Legal notice to him for recovery of your amount + interest.

Why hadn't you take action immediately when cheques had been returned uncashed?

Now you can file a police case for fraud and cheating as well as a civil suit for recovery.

You should have initiated cheque bounce cases u/s 138 NI Act when the cheques were returned. You have not done so.

Send legal notice for return of your money followed by case for recovery.

File criminal complaint of fraud with the police. If police refuse, can file direct complaint with the Magistrate u/s 156(3).

Timely inaction on the part of rightful party ultimately proves him unsuccessful. Still do take action.
