Society registration not renewed

at your mercy (Querist) 20 March 2019 This query is : Resolved
Ours (189 members) is flat owners society registered under Tamilnadu society registration Act .( Not co-operative societies act) The registration renewals missed for years purposely by the management guys The Bank or the registration dept does not bother even for years. The society uses the number only to show as if it has live registration. Please tell me who can intervene and insist on registration or if the registration is not mandatory

First with the help of a local good Civil Side Advocate explaining him all the details serve a Legal Notice to the Concerned Society Authorities

Inspect and obtain certified copy of records of Registrar of Societies (where your Society is registered) through a local prudent lawyer for better appreciation of facts/ documents, guidance and proper proceeding.

The filing of minutes in Registrar office is not compulsory. However check in your state as some rules framed under the Societies Registration Act vary from one State to other State. First obtain the copy of minutes filed by the society from the Registrar of Societies and also whether the society is filing updated minutes through RTI.. Basing on the information file complaint against the present EC members in District Court by consulting an experienced Advocate.
