Soceity name plates and billing query.

Our society have some members who have not registered their flats yet. Since their non-registration of flats we use to raise them bills as "OCCUPANTS" and also in society nameplates we have just mentioned the flat no. and NOT their names.

Now they are asking their names should appear on nameplates even though they have not registered their flats and have sent a letter to managing committee.

My question is, can society raise bills in their names and show their names on society name plates, even when their flats are not registered?

Please advice.

please clarify whether flats have been purchased by members directly from builder or on resale ? if on resale registration is not mandatory

I slightly disagree with Ajay Sethi. Registration is compulsory even if it is resale, since it is immovable property. For sale of any immovable property registration is compulsory. Otherwise the sale deed will not have any evidentiary value. They will not get any relief from the court. They will not get any loan from scheduled banks.

You cannot mention their name on name plates unless they register their flat.

But does law/ by-laws refrains housing society from issuing bills in unregistered members names or displaying their names on society nameplate? Is it an illegal act?

If they could not prove their title how will they justify using name plates against their flats?, a registered sale deed document is the proper title deed, so the denial by society is legally valid.
