Site purchase

Dear Sir,
I am purchasing a site in Bangalore,require suggestion of below queries related to purchase.

1. Site was purchased by mother (who is christian) in year 2002. She has 2 sons & 1 daughter.
2. Mother has registered GPA in her elder son's name in yr 2004.
3. Later elder son gave gift deed to his younger brother.

Now mother & both the sons are ready to register the site in our name. But daughter is a priest & is living out of karnataka so unable to come for registration.

Please suggest if we can proceed with purchase of this site without signature from daughter.

She need not be present and sign in gift deed.

We are third party so we are arranging for sale deed from mother(actual purchaser of site who is from christian community), Elder Son(who go GPA from mother) & younger son (who got Gift deed from GPA holder).we are not going for gift deed. So is it fine we go for sale deed without signature from daughter (child of site purchaser).

You can get the registered sale deed executed in your favor by the present title holder, i.e the younger son who has acquired the property by a gift deed, his signature alone is sufficient,neither mother nor her another son or daughter are necessary for registration.

Please indicate whether the GIFT deed in favour of the young son has been Registered with the Sub-registrar's Office by paying Stamp Duty? This is crucial before answering your query.

yes it is registered at registrar office.

IF GIFT DEED is registered in the name of younger son, only he is the absolute owner of the property and only he needs to sign the sale deed. NOBODY ELSE's signature is required.
