Shop on pagdi chandini chowk

(Querist) 27 September 2016 This query is : Resolved
Hi my name is apurv
I have an shop in chandini chowk , new delhi ...
It is on pagdi basis from last 25 years.
I have not paid the rent from last two months .. my father has died two months ago and today the owner told me that now after accepting rent you can not run the shop and vacate the shop.
Someone please help me what to do now to save the shop?
Raj Kumar Makkad (Expert) 27 September 2016
The contention of landlord is wrong that merely on demise of your father, you cannot retain that shop.

let him file the eviction petition. retain your possession thereto and meanwhile send the cheque of rent through registered post at his residential address or deposit in his bank account, if you know. If cheque/post returns back, get it deposited in the court.

Okay! What if i want to sale the shop?? Am i eligible to sale it?? If yes!! Then please let me know how??

If some buyer is ready to purchase such property on pagdi system then definitely you can do it but the same is not possible without the involvement of landlord. Generally ratio of 1/3 and 2/3 is made in old tenancies.

Explore the possibilities. May be your landlord ready to offer you some attractive amount for vacation. Explore that option also if offered.

Since so many repetitions and advises have not satisfied you,as advised by Dr. J.C. Vashista, engage a prudent lawyer in Delhi.
