Sexual harassment

(Querist) 14 October 2014 This query is : Resolved
Hi, The IPC now has Sexual Harassment (SH) as a distinct offence. Can can you tell me why exactly we need another one as SH at Workplace. Can't the SH at Workplace be handled under IPC?

What exactly is the relationship between the two enactments dealing with SH?

Would greatly appreciate clarity on this

1. The sexual harassment in workplace has been left for to be adjudicated through quasi judicial manner and whereas the sexual harassment under I.P.C. is a distinct crime to be tried by criminal courts. In the former case also the victim can still opt to file criminal complainant which then shall attract penal code provisions.

Mr. Sharma, thanks very much, so if once the matters is closed by the quasi judicial body, can it be reopened in courts, other than by way of appeal?

What is your concern about this, are you involved in any such offence?, or are you advocating somebody's cause?
Jacob M N (Querist) 20 October 2014
These days anybody can be involved at any point in time, because of the scope for misuse.

I am trying to understand, the aspect wherein SH can be brought before the internal complaint committee as also before the police. What is the exact nuance here??
