Seized passport

I am an Indian passport holder.My old passport being a hand written passport I applied for electronic passport in UAE.While checking I was informed my passport is a little damage(the paper was very old n there was a small tear)and I need to get an affidavit confirming it.I went and got an affidavit from the Indian Consulate in UAE and my new passport was issued and my old passport was returned with cancelled written in front.The first time when I travelled to India I had no problem in entrance and exit.But when I was exiting in 2017 for UAE I was told that my passport has not been cancelled and since it�s a damage passport I was asked to submit.I was told my passport will be returned once it is properly cancelled.Later after a month back I received a mail from the passport office in my India residence address that my passport is with them.On my return to India after 5 months when I tried to retrieve my old cancelled passport I was told it has been seized.I fail to understand on what bases they have cancelled my passport and how do I get back my old passport back.

You get another passport through fresh application online. through the below given link.

Or file a Writ of Mandamus in the in HIgh court of your State that the Passport Authorities impounded your passport without any valid reason i violating your rights under Artcles 14, and 21 Right to life and personal liberty and should release your Passport immediately or to set it at liberty and handover your passport to you.
