(Querist) 05 March 2015 This query is : Resolved
Hi,
I am in US from the last 1 year from 9th Feb 2914 onwards
I have H1 B VISA valid till 31st Sep 2015 now.
My h1B VISA is likely to get extended for another 3 years.
My wife has filed false cases Section 498A,504 ,506,420 and 406 case on 13th Dec 2014 in India
She is staying separate from me and my family from the last 1 year in India
I have no involvement in any of the cases.
My Father mother and Sister got bail as this was falase and basesless and there was no proof.
I hope this false open cases against me will not effect my Stay and employemnt in US ?

My Query is that my wife have told that she will inform about the open cases to US Consulate
and Indian Passport department.I have valid H1-B Visa in USA.and I have my passport stamped with me.
I hope there won't any issues if my wife approaches and informs US consulate about Section 498A another open cases.
Please let me know if I need to take any action.

This is routine cases in india ans is hardly taken note of it in abroad.
The visa is likely to be extended as most of the IT professionals abroad are slapped with these cases.
I would advise you to come to India and take bail and then concentrate in your work.

It is not possible for me to come to India now.If I get Vacation also it will be less than 2 weeks. My lawyers in India says no need to worry at all and no need to come to India. Our position in case is strong and even Judge is not listening to my wife.
But I am still worried. If they go to US Consulate in Mumbai with FIR and case details I hope that should not create any problem.Who is going to explain to them all these ?

you can come to india and apply for bail . then go back abroad fro work purposes
SHIVENDRA DUBEY (Querist) 05 March 2015
Will all these formalities completed in 2 weeks time ? My Lawyer suggests not to come to India as he will be able to take care of things .
Devajyoti Barman (Expert) 05 March 2015
No weeks time is not sufficient. US Consulate is over burdened with all these types of information and they hardly pay any heed to this.
You need at least a months time.

Presently act upon the advise of your lawyer.
T. Kalaiselvan, Advocate Online (Expert) 08 March 2015
Even in my opinion you may follow the advise of your lawyer and remain there itself until any serious development (unlikely) takes place here. The complaints regarding matrimonial disputes are lying in heaps in US embassy in local as well as that side unattended as the authorities are also aware that most of such complaints are on the basis of false information to wreak vengeance on personal notes.
