Second marraige in Islam

(Querist) 20 October 2017 This query is : Resolved
Hello.. Can some clearify my dout..im a Hindu and. I want to marry a Islamic guy who is already married with Islamic girl.. Is this marraige will possible without divorsing his first wife.
Vijay Raj Mahajan (Expert) 20 October 2017
No, you a Hindu woman cannot marry legally with Muslim man according to Civil form of marriage under the Special Marriage Act,1954 if he is already having another living wife. If he has to marry you under this Act of 1954 he has to first dissolve his first existing marriage and only after that he can marry you legally.

If you both marry according to Muslim form of marriage, than you will have to convert to Muslim religion before marrying him. The conversion to Islam just for the sake of marriage is not considered valid by the Supreme Court of India and the validity of the Muslim Marriage with him after your conversion to Islam will always remain doubtful in the eye of law. As a Muslim he can have 4 valid Muslim wives at one time if all these marriage were solemnised according to Shariat/Muslim law and Muslim form of marriage. However matrimonial life of all Muslim wives may not be smooth sailing with one Husband.
