Rti act 2005

Dear Experts,
Greetings of the Day!


1. I've given request for an information under RTI Act 2005 to the Circle Officer.

2. No response was received within the mandate period.

3. I've appealed to the 1st appellate authority/DDC. Unfortunately DDC was not the 1st appellate authority and it was informed over the phone to me from the DDC office.

4. I've appealed again to the 1st appellate authority/SDO describing the reason of late appealing.

5. No response was received within the mandate period again.

Now my quarry is :

A. Weather my application to the SDO was as per the law?

B. Shall I appeal to the State Information Commissioner for the information.

C. What if no response received from the SIC Office also?

D. Which is the higher authorities after the SIC?

E. Any case in the court of law can be filed against these authorities?

@ Devjyoti Barma : Sir my name is Manish Kr i've been cheated by the Circle Office and few others during purchase of a plot. I've applied for an Information under RTI Act 2005.

Sir my both topics are related to each other ... my this query is a part of the 1st query itself.

In your appeal, had you mentioned of the appeal submitted to the wrong authority and sought condonation of delay?

Any how, you can prefer a second appeal to the State Information Commissioner, if the appellate authority does not respond.

You can file a petition for deficiency of service on part of the officials in consumer court, which is the only venue where RTI petitioners are given relief.
State information commission can levy penalty on the officials for not furnishing the information but can not generally give relief to petitioner.
