Road accident case and passprt application

While driving I accidently hit a lady on the road. She got injured and filed a case against me under section 279/338 IPC.
I have been given the first date on 10th september 2015.

I lost my passprt and now to apply for re-issue, I have to declare any pending cases against me.
What options do I have?

In the passport application the applicant is required to reveal all the information abot him/her including the pending criminal cases or the disposed ones too within the period of consideration.
