Rights of wife and children on immovable property, husband m

Owner of land went missing after he became a Hindu sadhu 24 years back. Missing since then. Kindly advice right of wife and 2 children on the property. Presently there is a vacant land, can the wife and children build home in that land, if yes with what right?

So far as right is concerned, NO RIGHT of any legal heir until the missing owner of the property is declared judicially dead.

So far as building of home on the vacant land of the missing owner is concerned, they may do anything at their own risk & responsibility, if there is no objection from any side, but legally no ownership can bestow upon any of the heir till the property is inherited legally.

Let the person be declared dead by the court and the property mutated in the name of his heirs, his wife and children.
After this process the wife and his 2 children build the house and become it's lawful owner.

The husband/father has denounced the world and is missing since 24 years, as per your post.
What was he doing before he disappeared say employed?
If yes; he was in Govt or Private employment?
Was any missing person complaint lodged and has police submitted any report after tracing him? Has any court issued declaration of civil death?
Which personal law applies in this case say; Hindu?
The said land is self acquired or ancestral?

There are many threads and publications at LCI also narrating unsuspecting querists from Republic of India, having been allured and fleeced by posers, impostors that advertise the photo of a very old/sick persons posing as some Chief Lawyer (while actually LIAR) and flaunting unknown Firms as LAW Firms (while actually LIAR’s Firms)…………………..and having multiple fake ID’s to post Salutes from one fake ID to another fake ID…………………and falling for even Rs.50/- ( Pachaas Rupalli)………………. Such posers and impostors might be having their roots, origins, asal, asla and/or rooted in Tribal Bad Lands of Pakistan and may even approach your employer and share your details for few rupees.


Online portals are not substitute for in person discussions with very able senior LOCAL counsel as explained above and are for mere getting details and directions, and guidance and for FREE. As the cause at LCI is social service and Noble cause. You are not to pay any monies for it to any IT.

Declare the missing person as "dead" as per law and inherit his property as per your personal law, consult and engage a local lawyer for proper guidance and proceeding.
