Submission of resignation is one part whereas its acceptance is another, that you will agree.

Why and how the employer shall accept it during the pendency of an inquiry instituted?

Who forbids you to submit resignation, but resignation should not be taken as granted, as that is subject to acceptance by the competent authority.
