Sorry for the inconvenience caused to my dear lawyer friends, thought of writing a response myself with your help. However, I am quoting the entire text of the Show Cause notice for your advice.
"Madam,
It is found that you are not attending your duty from 17.10.2016 without any official information. The functioning of the office is jeopardized for this irregular activities. Please let us know the reason for such absence without intimation in duty to the undersigned within 72 hours of the receipt of the letter."

Xxx medical college & hospital
Kolkata
NB: She was absent due to her sickness, has leave in credit, produced a valid medical certificate from a registered medical practitioner after 5 days rest. She is 75% blind, had brain surgery in 1990. Presently in great emotional distress, hasn't happened in her carrier spanning 36 years. Please respond under West Bengal Service Rule.

No reply is justified for absence without permission/ sanction of leave. Better seek apology with some compelling reason, otherwise, 36 years of service would have to be said good bye without any terminal benefit, as the authorities can dismiss/ terminate on account of unauthorised absence.

But be aware, your absence without permission cannot be converted in to presence even by the ablest counsel's draft. Even sanction to leave due, if applied post fact, would depend solely at the discretion of the competent authority.

Sick leave due to Sickness is different from leave/absence to attend a party.


Nothing in case of sickness warrants phrases like ' Beware'.


The extract that you have posted is:



"Please let us know the reason for such absence without intimation in duty to the undersigned within 72 hours of the receipt of the letter."



Sickness has been intimated by Medical Certificate.


Rest trust the very able counsel and ability of Expert Mr. Devajyoti Barman and approach him with copy of said rules.

Admittedly, you had remained absent from duty without leave being sanctioned or applying for the same. Sanction of leave is not a matter of right but at the discretion of the Leave Sanctioning Authority. As such, the authority has sought your explanation before deciding the sanction of leave.
True, in a case of sickness, there cannot be prior sanction or application or even intimation. However, propriety requires that the employee ought to have informed the authority immediately thereafter, at least through through phone, email. The Medical Certificate produced should also conform to the norms. It is matter of routine that some of the employees are in the habit of producing medical certificates which are less than genuine.

In the instant case, if the employee was really sick, that itself would constitute the satisfactory explanation if duly authenticated by the doctor's prescription and the bills for the purchase of medicines.
